Breaking: Judge Drops Stormy Daniels’ Suit Against President Trump

The federal judge presiding over porn star Stormy Daniel’s defamation lawsuit against President Donald Trump dismissed the case on Monday afternoon.

The lawsuit centered on a tweet from the president where he claimed that the man Daniels (https://dailycaller.com/2018/01/12/trump-lawyer-releases-letter-from-porn-star-denying-affair-with-potus/)‘ alleges threatened her to keep quiet about her alleged affair with Trump was “nonexistent.”
Judge S. James Otero ruled the president’s tweet was not defamation, but “rhetorical hyperbole,” and dismissed the case.

Trump’s lawyer, Charles J. Harder, Esq. of Harder LLP, released a statement saying, “United States District Judge S. James Otero issued an order and ruling today dismissing Stormy Daniels’ defamation lawsuit against President Trump. The ruling also states that the President is entitled to an award of his attorney’s fees against Stormy Daniels.”
It also said, “No amount of spin or commentary by Stormy Daniels or her lawyer, Mr. Avenatti, can truthfully characterize today’s ruling in any way other than total victory for President Trump and total defeat for Stormy Daniels.”

Avenatti, who is also considered to be a likely 2020 Democrat contender, tweeted, “Re Judge’s limited ruling: Daniels’ other claims against Trump and Cohen proceed unaffected. Trump’s contrary claims are as deceptive as his claims about the inauguration attendance. We will appeal the dismissal of the defamation cause of action and are confident in a reversal.”
Daniels is also legally obligated to pay Trump’s legal bills as a part of the judge’s ruling.
The porn star alleges that she had an affair with the president and that his former lawyer, Michael Cohen (https://dailycaller.com/2018/09/08/michael-cohen-files-stormy-daniels/), paid her $130,000 to keep quiet right before the election.
Avenatti has had a couple big losses in recent months. Despite gaining notoriety for representing Daniels, he also took on a woman who alleged Justice Brett Kavanaugh drugged and raped women back when he was in high school. Many have blamed him (https://dailycaller.com/2018/09/25/michael-avenatti-brett-kavanaugh/) for Kavanaugh’s confirmation, saying his client’s allegations were so outlandish it took away from other more likely accusations.

Not really. Such agreements are signed daily. It is rare for them to be violated. The penalty for violating the agreement- which is part of the contract- tends to be very high to provide motivation to not violate the agreement. And if Trump sues, there won't be much of a hearing. Did you sign this (Yes). We have evidence that you violated it. You owe Trump a ridiculously large amount of money to which you agreed to in advance. Hearing over.

One possibility is that anti-Trump groups offered to pay this cost if Stormy would violate the agreement by going public.
