Judge orders Justice and State to reopen narrow inquiry into handling of Clinton email records lawsuit (https://www.washingtonpost.com/local/legal-issues/judge-orders-justice-state-departments-to-reopen-narrow-inquiry-into-handling-of-clinton-email-records-lawsuit/2018/12/06/71d03530-f9a1-11e8-863c-9e2f864d47e7_story.html?utm_term=.8369290577ea)

There is going to be another look at Hillary's private server and an attempt to clear up possible bad faith by the investigators.

A U.S. judge ordered the Justice and State departments Thursday to reopen an inquiry into whether Hillary Clinton used a private email server while secretary of state to deliberately evade public records laws and to answer whether the agencies acted in bad faith by not telling a court for months that they had asked in mid-2014 for missing emails to be returned.

The order risks reopening partisan wounds that have barely healed since Clinton’s unsuccessful 2016 presidential bid, but in issuing the order Thursday, U.S. District Judge Royce C. Lamberth said the spirit of the Freedom of Information Act required it.

In a narrow but sharply worded 10-page opinion, Lamberth wrote that despite the government’s claimed presumption of transparency, “faced with one of the gravest modern offenses to government openness, [the Obama administration’s] State and Justice departments fell far short” of the law’s requirements in a lawsuit for documents.

Lamberth added that despite President Trump’s repeated campaign attacks against Clinton for not making her emails public, “the current Justice Department made things worse” by taking the position that agencies are not obliged to search for records not in the government’s possession when a FOIA request is made.

More waste on another witch hunt on Hillary's email. One wonders if America is really this dumb or is this simply distractive nonsense to keep the uneducated busy looking in the wrong direction. FD I managed the email system for a major corporation for years and was security trustee. I may forgive the judge, for he is a judge and could be and probably is a technological dummy. I've tutored too.

Do you think they'll investigate Ivanka's email use of a outside company which is more insecure than Hillary's personal sever? If you don't know why think about it for a minute. Hint: email is not isolated to a single place and public systems have public admins.

And how about Colin Powell or Condeleeza Rice? They too use public email systems for government work. Again more insecure than Hillary. But Hillary's email is a meme for the right, no thought, no real knowledge of email use, no reading of the many investigations. That people can be so easily played astounds me.

The judge indicated that he was mislead in the first hearing. He wants answers.

What does Ivanka have to do with it?

And that is only because of Judicial watch, not your R Congress, the DOJ or state dept.

Look, the emails belong to me. She had no right to destroy my property. If Ivanka was an employee, I feel the same way. If you feel that way about Condi or anyone else, issue a FOIA request.

Right, this was one of the FOIA cases that had the judge so upset because the Government was refusing to comply with his orders.

Midcan and his ilk wish it would all just go away.

Right. This was one of at least 10 FOIA lawsuits that the DoJ was dragging their feet on, and making misrepresentations to the judge. But Midcan and his ilk want it to just go away.

Question: Does anyone know of a Website that tracks the cost of these dog and pony show investigations into Clinton and Trump and his team? We all know neither will ever effect either of them, matter much or change anything . If we are honest with ourselves we knew that going in.

So how much money and resources are being spend on the slight of hand distraction show?

A Freedom of Information Act request is not a dog and pony show. It is the primary way for a citizen to get information about what our government is doing when politicians and government don't offer that information voluntarily.

See the MKUltra thread: the CIA would not have released those documents without a citizen willing to file a FOIA request and then fight to fulfill this rights as an American citizen.

I have nothing against FOI , especially in a regime where there are trillions of pages of classified documents. I simply wasn't clear enough about the fact that I am referring to the whole process of these two "investigations"
In the end Hilary and Donald will be unaffected although there will be lambs to be sacrificed. The voters will pay millions, the debt will climb a bit and the "show" will help hide what government is doing. Or more likely hide what they are NOT DOING. Which would be much of anything helpful to the average American.

Hillary is way above the law, this is a waste of time, nothing is going to happen to her even if she's guilty.

Federal Judge Rips State Department for Helping to Bury Hillary's Email Scandal....

A federal judge ripped the State Department during a court hearing this week and accused officials there of helping to cover up former Secretary Hillary Clinton's unlawful use of a private email server. The judge also took aim at the current Department of Justice.

Judicial Watch announced today that, in a ruling excoriating both the U.S. Departments of State and Justice, U.S. District Court Judge Royce C. Lamberth has ordered both agencies to join Judicial Watch in submitting a proposed schedule for discovery into whether Hillary Clinton sought to evade the Freedom of Information Act (FOIA) by using a private email system and whether the State Department acted in “bad faith” by failing to disclose knowledge of the email system. The decision comes in a FOIA lawsuit related to the Benghazi terrorist attack.

Terming Clinton’s use of her private email system, “one of the gravest modern offenses to government transparency,” Lamberth wrote in his MEMORANDUM OPINION:

… his [President Barack Obama’s] State and Justice Departments fell far short. So far short that the court questions, even now, whether they are acting in good faith. Did Hillary Clinton use her private email as Secretary of State to thwart this lofty goal [Obama announced standard for transparency]? Was the State Department’s attempt to settle this FOIA case in 2014 an effort to avoid searching – and disclosing the existence of – Clinton’s missing emails? And has State ever adequately searched for records in this case?

At best, State’s attempt to pass-off its deficient search as legally adequate during settlement negotiations was negligence born out of incompetence. At worst, career employees in the State and Justice Departments colluded to scuttle public scrutiny of Clinton, skirt FOIA, and hoodwink this Court.

Lambert accused DOJ attorneys of "double speak" and "misleading" the court on the same issue…..snip~

The American people demand more than just some admonishing. Time to hook those specific people up for playing games with the court. They obstructed a Court of law. All to cover for Hillary. They aided and abetted criminal conduct.

The Court should recommend that the cases be re-tried. With charges upon specific people for Obstruction and for intentionally deceiving The Court. What say ye?

OK. The FOIA cases were separate from the investigations. And they got more relevant information than the investigations.
