Lawyers for Covington Kid Send Letters to News Outlets, Celebrities: CNN, NYT, Chuck Todd, Jim Carrey

Lawyers representing the Covington Catholic High School boy who was confronted by Indian activists after the March for Life -- for which he was criticized as being racist, hateful, toxic, and a white nationalist -- have sent at least 50 letters to major news outlets and celebrities to preseve all documentation (emails, texts, etc.) they have about the young man, in preparation for a potential lawsuit against those entities.

Cupp, The Post's Kristine Phillips, NYT's David Brooks, NYT's Maggie Haberman, NBC's Andrea Mitchell, NBC's Chuck Todd, HBO's Bill Maher, Sen. Elizabeth Warren (D-Mass.), Kathy Griffin, Alyssa Milano and Jim Carrey.


The letter, from Attorney Todd McMurty (http://www.hemmerlaw.com/attorney-profiles/todd-v-mcmurtry/) with Hemmer, DeFrank, Wessels Attorneys at Law, partly states, "Our law firm represents the family of Nick Sandmann regarding the unfortunate incident in Washington D.C. on January 18, 2019, and the XXXXX’s response to same (the “Sandmann Matter”). I write on behalf of our clients to notify you of your obligation to preserve information that may be relevant to potential litigation between our clients and the XXXXX.

"Please forward this letter to your legal counsel immediately. Please preserve all information that may be relevant to the Sandmann Matter. If our clients pursue litigation, we intend to serve the XXXXX with discovery requests to access your computer networks and systems, and to seek the production of relevant documents and communications. ... [Y]ou must preserve all information and documents relating to the Sandmann Matter during the period from January 17, 2019 to the present."

You obviously haven't watched the entire video. I know, it can be tough to sit still long enough to watch it, but what msm claimed to happen did not and everyone, including yourself jumped all over this kid without watching the whole event.

It was not a "misunderstanding". It was an orchestrated attempt to defame a high school student for being white and male. It was a rush to judgement with an attempt to ruin these boys without a shred of evidence. It was not an "oh gee, we are sorry but that's how it looked to us" event. Everyone who spread the false narrative about this deserve to lose everything they have or will ever have.

To claim this was a "misunderstanding" shows you to either be a total idiot or someone who should be on the lawyers hit list.

It is not meant to be scary, it is a way to inform someone that there is the possibility of legal actions to prevent them from destroying evidence. It is my understanding that it is quite common and it is a sound part of the process.

When have most of these media outlets "corrected" the misunderstanding? Even on the today show interview, you could see and hear the slant against the kids, I have not seen anything that any news outlet has apologized for what was done. Maybe it is out there but I have not seen it.

So, give these families their day in court. First, because public figures used their media platforms to slander these students including many in the mainstream media and newspapers. Secondly, in realization that the American Way isn't an appropriate lawsuit as you assert here, the American Way has now become the hook, line, and sinker swallowing of every morsel of manure the media throws out. The American Way has now become leap first, look second.

The third reason to give these families their day in court....it's the right thing to do.

That is an overreach and may have been done for tactical reasons- suits against FB and Twitter likely won't go anywhere. An adverse ruling would turn FB and Twitter into sites that have to moderate each draft post prior to allowing it to be posted.

But the media and other individuals who harmed these children are in legal jeopardy.

They arent being held to acct for current events thats the basis of this lawsuit. They are being sued for Libel, and harrassment and slander. Another words lying about the entire incident, how it happened, whose fault it was and then attacking viciously those that were the actual victims and continuing to do so AFTER all the facts were known

Each media outlet that ran with the 15 second snip should have double-checked the whole incident instead of the originating company's tale. Each one that ran with it should be held responsible.
Is it NOT the responsibility of subsequent reporting agency to double check their facts before running the piece? Well.............of ABC says it's true.....that is no excuse. And those actors in Hollyweird that demanded he be ostracized from society should be especially held accountable. Then we get to Colbert......he kept pounding the lie up his listeners' ass even after he know what the facts really were......as if he ever tells the truth about anything.

Yes, civil suits to recover damage to individuals is the American Way. I would think that the attorney would take this on a 1/3 or 40% contingency. Remember, on a contingency fee basis the lawyers put up all of the money and work for free -- in other words, take all of the risk that they'll recover something. Hence the 1/3 - 40% agreement.

Your homeowners policy in all likelihood provides you with "personal injury" coverage - and if you look at the definition of "personal injury" you will see defamation as one of the defined offenses. This is in contrast to bodily injury or property damage coverages. I have defended many defamation cases - business and personal ones. Damage to reputation can be real and tangibly defined.

I will be watching closely as to how this turns out, because if individuals are held at fault for reporting on current events based upon evidence on hand at the time, I see that being a slippery slope especially in regard to the federal government and comments from the president.
