With 2010 revenues of $67.8 billion and profits of $8.2 billion, Pfizer Inc. ranks #31 on the Fortune 500 and is the world's largest pharmaceuticals corporation. Brand names include Viagra, Celebrex, Norvasc, and Lipitor. The company also manufactures animal care products such as Revolution, an anti-parasitic. In 2009, Pfizer acquired its rival Wyeth for 68 billion dollars. Wyeth's over the counter brands included Advil, Centrum, Robitussin and ChapStick. "The pharmaceutical giant Pfizer agreed to pay $2.3 billion to settle civil and criminal allegations that it had illegally marketed its painkiller Bextra, which has been withdrawn. It was the largest health care fraud settlement and the largest criminal fine of any kind ever... It was Pfizer's fourth settlement over illegal marketing activities since 2002... The government charged that executives and sales representatives throughout Pfizer's ranks planned and executed schemes to illegally market not only Bextra but also Geodon, an antipsychotic; Zyvox, an antibiotic; and Lyrica, which treats nerve pain. While the government said the fine was a record sum, the $2.3 billion fine amounts to less than three weeks of Pfizer's sales. Much of the activities cited Wednesday occurred while Pfizer was in the midst of resolving allegations that it illegally marketed Neurontin, an epilepsy drug for which the company in 2004 paid a $430 million fine and signed a corporate integrity agreement - a companywide promise to behave. 'The whole culture of Pfizer is driven by sales, and if you didn't sell drugs illegally, you were not seen as a team player,' said Mr. Kopchinski, whose personal share of the Pfizer settlement is expected to exceed $50 million. Mr. Kopchinski left Pfizer in 2003. Altogether, six whistle-blowers will collect $102 million from the federal share of the settlement and more from states' shares. Forty-nine states and the District of Columbia will collect $331 million, with New York State alone getting $66 million. Only South Carolina chose not to participate in the settlement... As news of the riches earned by whistle-blowers spread through the industry in recent years, scores of fraud cases have been filed by former drug sales representatives using a Civil War-era law that pays a bounty for fraud alerts. The cases charge that illegal drug marketing cost the federal Medicare and Medicaid program millions."

"Sidney Wolfe, director of Public Citizen's Health Research Group, said the Pfizer settlement 'may sound large, but it's not enough to ensure drug companies will curb their bad behavior.' Wolfe pointed out that the Pfizer agreement topped a landmark settlement set by Eli Lilly in January, when that company paid more than $500 million in criminal penalties for improper marketing of the antipsychotic drug Zyprexa. Five other major drug manufacturers logged smaller settlements over the past decade... 'The U.S. pharmaceutical industry, long one of the most profitable in the country, with profits last year of close to $50 billion, has engaged in an unprecedented amount of criminal activity in the past decade,' Wolfe said. 'Unfortunately, the ever-escalating fines are unlikely to stop drug companies from continuing to bribe doctors because they represent just a fraction of drug company profits and no one has gone to jail.'"

Pfizer fined $106 million for drug price increase of 2,600% in Britain
Dec. 7, 2016 -- Britain's antitrust regulator fined Pfizer Inc. a record $107 million Wednesday because of skyrocketing price increases for generic versions of the Epanutin anti-epilepsy drug.


The Competition and Markets Authority announced Pfizer and drug-distribution company Flynn Pharma hiked prices of the drug by up to 2,600 percent for around 48,000 patients in the country in September 2012. Pfizer had transferred distribution rights to Flynn, which sold the medicine by its generic name, phenytoin sodium. Flynn was fined $6.55 million. "The companies deliberately exploited the opportunity offered by de-branding to hike up the price for a drug which is relied upon by many thousands of patients," Philip Marsden, chairman of the Case Decision Group for the CMA's investigation, said in a statement. "These extraordinary price rises have cost the [National Health Service] and the taxpayer tens of millions of pounds.''

The NHS spent about $63 million on the anti-epilepsy capsules in 2013 and $50 million in 2014, the CMA said in its August 2015 complaint. The prices jumped 25 fold. The 100-milligram packs of the drug soared from $3.53 to $84.69, before dropping to $68.05 starting in May 2014, the CMA said Wednesday. Warwick Smith, an official with the British Generic Manufacturers Association, an industry body, told The Wall Street Journal the two companies "broke the virtuous cycle" between innovator and generic companies when drugs sharply fall in price after they lose their patent protection.

Both companies plan to appeal. "Phenytoin capsules were a loss-making product for Pfizer and the Flynn transaction represented an opportunity to secure ongoing supply of an important medicine for patients with epilepsy, while maintaining continuity of manufacture," the company said in a statement. "When Flynn launched its product, the company set a price that was between 25 and 40 percent less than the price of the equivalent medicine from another supplier to the NHS which had long been regulated, and appeared to be acceptable to, the Department of Health."

A Flynn spokesman said, "Phenytoin sodium capsules are already less expensive than the alternative equivalent drugs in the U.K. market. It beggars belief that the CMA seeks to punish Flynn for selling phenytoin capsules at a significant discount to phenytoin tablets." The CMA calculated that, according to Pfizer's figures, all such losses would have been recovered within two months of the price increases. "This is the highest fine the CMA has imposed and it sends out a clear message to the sector that we are determined to crack down on such behavior and to protect customers, including the NHS, and taxpayers from being exploited," the CMA's Marsden said.

Phenytoin sodium is sold as Dilantin in the United States. Other drugmakers have been blasted for soaring prices. In 2015, U.S. pharmaceutical executive Martin Shkreli's Turing Pharmaceuticals bought the rights to Daraprim, a half-century-old drug that treats a parasitic infection, and raised the price more than 50-fold. And Mylan has rocketed the price of its injectable medication EpiPen to more than $600, a six-fold increase from 2007.

Shkreli, a supporter of Republican President-elect Donald Trump, had dogged freelance reporter Lauren Duca, including sending her requests for dates, after she wrote an op-ed piece for Teen Vogue that was critical of Trump. Shkreli, who caused controversy for hiking the price of an anti-parasitic drug to $750 a dose while head of Turing Pharmaceuticals LLC, had his Twitter account suspended for harassment, the San Francisco-based microblogging service said in an emailed statement. After the suspension, Duca tweeted, "Why is harassment an automatic career hazard for a woman receiving any amount of professional attention?"

Duca had drawn media attention for her article in December arguing that Trump had conned U.S. voters. Shkreli then tweeted about trying to date her, and he sent her an invitation on Thursday to attend Trump's Jan. 20 inauguration as his guest. Duca replied on Twitter, "I would rather eat my own organs." Shkreli later posted a collage of photos of Duca, and updated his profile picture with a photo of Duca and her husband showing Shkreli's face superimposed over that of her spouse. Duca retweeted the pictures on Sunday, asking Twitter founder and Chief Executive Jack Dorsey why they were allowed on the social network. "I feel sick," she wrote.

Shkreli, who is in his 30s, became known as the "pharma bro" after he taunted detractors who criticized him for increasing the price of the drug Daraprim. He was forced to step down as Turing chief executive in 2015 amid criminal and civil securities fraud charges alleging he ran a Ponzi-like scheme while at the hedge fund MSMB Capital Management and while he was top executive at Retrophin Inc (RTRX.O), another drug company. Turing is the subject of antitrust probes by the Federal Trade Commission and the New York attorney general's office stemming from its increase in the Daraprim price.

Jan 31 2017 - U.S. President Donald Trump in a meeting on Tuesday with pharmaceutical executives called on them to manufacture more of their drugs in the United States and cut prices, while vowing to speed approval of new medicines and ease regulation.


Trump told them the government was paying "astronomical" prices for medicines in its health programs for older, disabled and poor people and said he would soon appoint a new U.S. Food and Drug Administration leader. "We’re going to streamline the FDA," Trump said in a statement, referring to the regulatory agency responsible for vetting that new drugs are safe and effective. The meeting between Trump and the pharmaceutical executives signaled a defusing of tensions that have kept drug stock prices in check since the presidential election. Shares of most of the group rallied on Tuesday following the meeting, even as the broader stock market slid. “Trump is a populist above all else, and having these (drug) prices skyrocket, he’s commented that under his administration, this is not going to happen,” said market strategist Quincy Crosby of Prudential Financial in Newark, New Jersey.

She said Trump was playing a balancing act between controlling prices and loosening regulations. "I don’t think the majority of Americans want all regulations lifted from drug makers.” Attending the meeting were top executives at Merck & Co Inc, Johnson &, Celgene Corp, Eli Lilly & Co, Amgen Inc and Switzerland's Novartis AG <NOV N.S> as well as the head of the Pharmaceutical Research and Manufacturers of America (PhRMA) lobbying group. Celgene, Lilly, Merck and Amgen said by email after the meeting that they were encouraged by Trump's focus on innovation, tax reform and the need for a more value-driven health care system. Lilly said discussion topics also included stronger trade agreements and removing "outdated regulations that drive up costs and slow innovation." PhRMA echoed those points in its own post-meeting statement, adding that the policies, if enacted, would result in up to 350,000 new jobs over the next 10 years. "Tax, deregulation - those are things that could really help us expand operations," Lilly CEO Dave Ricks said. We need tort reform and I believe a curtailing of direct marketing of prescription drugs. Asking my doctor if ________ is right for me is BS. Plus doctors should have no financial interest in the drugs they prescribe.

Tort reform on a national basis is going to be problematic. There's no real basis for national tort liability reform. It's on a state-by-state basis. Ohio enacted tort reform in 05, I think.

Eccentric hedge fund operator Martin Shkreli found guilty of fraud
4 Aug.`17 - Martin Shkreli, the eccentric former pharmaceutical CEO notorious for a price-gouging scandal and for his snide "Pharma Bro" persona on social media, was convicted Friday on federal charges that he deceived investors in a pair of failed hedge funds.


A Brooklyn jury deliberated five days before finding Shkreli guilty on three of eight counts. He had been charged with securities fraud, conspiracy to commit securities fraud and conspiracy to commit wire fraud. Prosecutors had accused Shkreli of repeatedly misleading investors about what he was doing with their money. Mostly, he was blowing it with horrible stock picks, forcing him to cook up a scheme to recover millions in losses, they said. Shkreli, 34, told "lies upon lies," including claiming he had $40 million in one of his funds at a time when it only had about $300 in the bank, Assistant U.S. Attorney Alixandra Smith said in closing arguments. The trial "has exposed Martin Shkreli for who he really is — a con man who stole millions," added another prosecutor, Jacquelyn Kasulis.

But the case was tricky for the government because investors, some wealthy financiers from Texas, testified at the trial conceded that Shkreli's scheme actually succeeded in making them richer, in some cases doubling or even tripling their money on his company's stock when it went public. The defense portrayed them as spoiled "rich people" who were the ones doing the manipulating. "Who lost anything? Nobody," defense attorney Ben Brafman said in his closing argument. Some investors had to admit on the witness stand that partnering with Shkreli was "the greatest investment I've ever made," he added. For the boyish-looking Shkreli, one of the biggest problems was not part of the case - his purchase in 2014 of rights to a life-saving drug that he promptly raised the price from $13.50 to $750 per pill. Several potential jurors were kept off the panel after expressing distain for the defendant, with one calling him a "snake" and another "the face of corporate greed."

The defendant also came into the trial with a reputation for trolling his critics on social media to a degree that got him kicked off Twitter and for live-streaming himself giving math lessons or doing nothing more than petting his cat, named Trashy. Among his other antics: boasting about buying a one-of-a-kind Wu-Tang Clan album for $2 million. During about a month of testimony, Shkreli appeared engaged at times, grinning when his lawyer described him as a misunderstood misfit. Other times he looked bored, staring into space and playing with his hair. Shkreli, who comes from an Albanian family in Brooklyn, was arrested in 2015 on charges he looted another drug company he founded, Retrophin, of $11 million in stock and cash to pay back the hedge fund investors.

"Sidney Wolfe, director of Public Citizen's Health Research Group, said the Pfizer settlement 'may sound large, but it's not enough to ensure drug companies will curb their bad behavior.' Wolfe pointed out that the Pfizer agreement topped a landmark settlement set by Eli Lilly in January, when that company paid more than $500 million in criminal penalties for improper marketing of the antipsychotic drug Zyprexa. Five other major drug manufacturers logged smaller settlements over the past decade... 'The U.S. pharmaceutical industry, long one of the most profitable in the country, with profits last year of close to $50 billion, has engaged in an unprecedented amount of criminal activity in the past decade,' Wolfe said. 'Unfortunately, the ever-escalating fines are unlikely to stop drug companies from continuing to bribe doctors because they represent just a fraction of drug company profits and no one has gone to jail.'"
