Grand jury testimony is kept secret by law. No one, not even the congress can have access to grand jury testimony. The Democrats know this, but they are asking a federal judge to ignore the law and basically legislate from the bench.


Why don't Democrats instead introduce a bill which will allow them access if they can show probable or just cause? Democrats continue to demonstrate that they consider the law an obstacle which must be disregarded.

That means they have nothing. No law-abiding judge would even entertain the notion.
They'll either seek the 9th Circuit Court or the fed court in DC

No reasonable judge would allow it. He would tell them that they have the ability to seek a change in the law. But that doesn’t mean some politically motivated judge wouldn’t go the other way on this.

Back during the Starr investigation era, grand jury testimony was not required to be kept secret. It could be released under certain conditions. One of those conditions was a request by the congress. Democrats created this law in response to Starr releasing the testimony as he was then required to do. Now they want to ignore this law.

The reason this secrecy is important is because grand juries operate under much looser standards than a criminal trial. People can be harmed through the release of this testimony even if there was no evidence to gain an indictment against them.

The judge should slap sanctions on them for filing a frivolous lawsuit.
