View Full Version : Why the Filibuster Change is Fantastic News for Obama.

The Senate's historic "nuclear option" vote Thursday to end the filibuster for executive nominees and most judicial nominees is excellent news for President Barack Obama.

Obama's second-term agenda largely runs through the powerful D.C. Circuit Court of Appeals, which often has the final word on matters of White House and executive branch authority. That's the strongest tool Obama has to still get things done, because as long as Republicans control the House, his legislative agenda isn't going anywhere. The Senate rules change clears a path for the president to confirm his three stalled nominees to vacancies on the conservative-leaning court, and make it less hostile to his executive actions.

"There will be more judges on the court now who will follow the Constitution and laws as written, rather than reach ideologically-driven results," said Judith Schaeffer, the vice president of the Constitutional Accountability Center, a liberal legal advocacy group. "The President's executive actions and his legislative accomplishments will be in good hands with judges who follow the law."

The D.C. Circuit has been the GOP's most potent weapon against Obama's use of executive power, as it has overturned a slew of his regulations on health care, financial reform, environmental protection, labor rules and recess appointments. Most recently, a three-judge panel on the court struck down Obamacare's contraception mandate.

The federal court system is short by dozens of judges, because of long-term right-wing filibustering and refusing to fill empty seats. Furthermore, because the Senate Democrats can push through judges at will, we've just changed flipped the DC Circuit Court from right-wing lunacy to 7-4 majority progressive sanity. Other courts will see similar changes.

Also, Obama can fill lots of empty posts in the Executive Branch, and he can now fire bad-performers without worrying about yet another Senate confirmation fight that's as fun as a root canal.

This is a HUGE victory. Watching the GOP in maximum butt-hurt has never been sweeter!

If it wasn't so sad, that would make me laugh. President Obama's hatred of the Constitution are well known. He ignores the Constitution at his leisure. He's been caught more than once and chafes at the pesky Constitutional checks and balances. This move towards a dictatorship is just another example of his, and the Democrats, unwillingness to accept checks and balances. It's a dictatorship or nothing for them.

But, kudos to your handlers for sending you a silly post.

presidents appoint judges... wingnuts who only want to win in rightwingnut extremist gerrymandered districts don't.

but it's kind of funny since baby bush wanted to appoint someone to the high court who didn't know what search and seizure is and another wacko (whom he did disgrace the bench with) who think corporations have corporate religious consciences.

now, instead of the 3 judges that they wanted for the District of Columbia, you're going to get more than 80

yay.... judges who actually know what stare decisis and precedent are!

President appoint and, until the unconstitutional Obama, the senate confirmed. I understand why, being a racist liberal, precedent is holy to you. You're eager to bring back slavery, for all Americans except the elites.

I think Jillian would be quite content for the Congress to disband and Obama simply rule on his own. He's been trying his damndest to do so, always with her enthusiastic support.

Jillian doesn't believe in the Constitution, in personal freedom, capitalism or any of that other nonsense that made America great and whose decline is now pacing the decline of America.

Jillian loves the NSA spying on her, worships at the feet of the state and honestly believes the thieves in D.C. can create a socialist paradise if only given the chance.

We will all be watching closely as Jillian and her new mayor attempt to create their own socialist paradise in NYC.

Are you not familiar with "...he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law...."

at least now we'll have 80 judges who know what the law is instead of imbeciles who think there is such a thing as "corporate conscience".

And if you look at the Facts on Obama, and not the Democratic talking points, he has not faced any harsher approvals of his justices than anyone else, he just keeps sending the same candidates back again and again and again

But then again you are a liberal and that means that you will accept lies and disregard the truth.

Why do you think that he is adding justices to the courts? because he can add liberal loons to off set the conservative courts!

The only way to offset this move is to do the same and then send a constitutional amendment to the people so the Democrats that constantly try and piss on the constitution can't do this again!

Do we need to post what all the Democratic leaders said about this move when they were blocking every Bush proposal? They thought is was a really bad idea back then and they were right.

No there is no choice accept for possible the house to defund the courts to stop this power grab!

Lost in emotionalism you completely miss the point zelmo made that this action by Dems will come back to haunt when Reps are again the majority. As a strist you completely miss the fact that this action has only increased the power of government.

They believe that the American people will continue to vote in their direction and that this rule will never come back to haunt them.

It is quite unprincipled and the very best argument that has been submitted in this thread is that of revenge. "At least we'll have judges whom..." argument, implying that he/she knows the rule is bollocks but doesn't care.

Much ado comes from politicians every regime change in the States about the other side being obstructionist, but no one truly cares enough to be the first side to lay down arms. The very fact that Americans are so polarised that they see this some sort of war but not avenue for cooperation, among other things, lays the footwork for the fall of their empire.

This is history and we are writing it. Remember this day.

Obama is not the first POTUS to try and pack a court to circumvent the checks and balances of the Judicial system on the Executive. Lincoln threatened it to get his war of northern aggression ratified after the fact, Roosevelt tried to do it to get his clearly unconstitutional encroachment on the private sector ratified and now Obama is doing it specifically to unbalance the D.C. Court of Appeals to keep that court from making the obvious ruling that his unilateral rewrite and selective enforcement of ObamaCare is illegal.

That's all this is about, really. Obama knows that if he is forced to implement the law as written, he and the Democrats are absolute toast next year. They are going to try and delay it beyond the 2014 election with clearly illegal Executive Edicts. They are trying to make sure that their partisans prevent this court, which would be ruling on challenges to this illegality, from stopping same.

When it comes to partisanship, American politicians, pundits and players do recognize disagreement with their views, but in a disagreeable way try to demonize and marginalize the opposition as evil extremists.
