After losing all major statewide races to Democrats for the first time in 24 years, Republicans in Virginia are pushing to replace a moderate GOP congressman with a candidate so conservative that he doesn’t even believe that spousal rape should be a crime.

On Wednesday, Mother Jones pointed out that state Sen. Richard H. “Dick” Black, who is running to take over retiring Rep. Frank Wolf’s seat, had fought against making spousal rape a crime because the woman was “sleeping in the same bed, she’s in a nightie.”

Democrat Shawn Mitchell had uncovered the 2002 video of Black talking about spousal rape for an attack ad during the 2011 campaign for Virginia state Senate.

In 2001, Black asserted that emergency contraception was “baby pesticide” and he recently compared the Supreme Court ruling that legalized abortion to the Holocaust.

If I have sex with my wife and the next day she wakes up on the wrong side of the bed and files charges for rape. Goes to the ER, gets the rape kit thing done, all my DNA is in there - what's my defense?

The hard truth is spousal rape never gets a conviction. It's a waste of the courts time. I'm not sure the comfort level I have with this, but I've never seen anyone receive anything in 6 years for allegations of spousal rape.

I presume spousal rape that includes resistance would also cover bruising and signs of a fight. Otherwise it's his word against hers and I can see how that could be abused.

Do you mean Mother Jones doesn't include the context when they write their story?

For years, husbands who violently raped their wives could be arrested and prosecuted for various charges of assault. Men did go to jail for these assaults. Whether sex occurred during these assaults or not was irrelevant.

Then, the laws changed. Rape no longer involved force or threats of force. Any form of coercion was sufficient. A lawyer explained to me that a wife having sex with her husband when she would rather not was rape. That's fine. That's what the lawyers and some political groups wanted.

And that brings us to the prosecution. In a rape case where a woman is assaulted by a stranger and he forcibly has sex with her there is physical evidence. Hairs, fibers, semen, and more recently, DNA that is used to prove that a specific man had sex with a specific woman. But, none of that matters in a marital rape case because the fact that they had sex is not disputed. In a normal rape case there is sometimes physical injury. Black eyes, busted lips, vaginal tearing, and worse. Those are rarely there in cases of marital rape.

So, you have him saying they had consensual sex and her saying she didn't want to. Well, no does mean no so did she say no? Not necessarily. Saying no or indicating in any way you don't want to have sex isn't required. All that's required is, "I didn't want to."

How is this done?

I'm not saying it doesn't happen, but I tend to think the likelihood of it being used more as a tool of belligerence is pretty high.

He's not saying there isn't spousal rape, or that it's bad. He's saying it's difficult to prove.

I don't know what else he's said about spousal rape, and his comment about abortion being like the Holocaust is inane.

If he's smart, he has to say very quickly that he agrees spousal rape is very bad and should never be acceptable in any marriage.
