Excellent news. It's time the legislative branch started challenging the executive on a lot of these blatant abuses of power. It gets worse with every administration.

Criminally Negligent Manslaughter

A homicide resulting from the taking of an unreasonable and high degree of risk is usually considered criminally negligent manslaughter.

No doubt Operation Fast and Furious did do the above. Putting guns in the hands of known murderous cartels is the poster child of "taking of an unreasonable and high degree of risk".


Jurisdictions are divided on the question of whether the defendant must be aware of the risk.

Allowing guns in the hands drug cartel members? How could anyone with even a sliver of a brain not be aware of the risk to life of doing that?


There are numerous cases in which an omission to act or a failure to perform a duty constitutes criminally negligent manslaughter. The existence of a duty is essential.

Law Enforcement officials who were aware of what was going and failed to perform their duty to protect life by speaking out over the unreasonable and high degree of risk would be doing the above.


Since the law does not recognize that an ordinary person has a duty to aid or rescue another in distress, an ensuing death from failure to act would not be manslaughter. On the other hand, an omission in which one has a duty, such as the failure of a lifeguard to attempt to save a drowning person, might constitute the offense.

When Holder became aware of Fast and Furious and the fact they were losing track of the guns, his duty was to shut the operation down due to it's high degree of risk.


When the failure to act is reckless or negligent, and not intentional, it is usually manslaughter. If the omission is intentional and death is likely or substantially likely to result, the offense might be murder.

Just as you can't hand a loaded gun to a child, then say you had no idea anyone would get hurt, the Justice Dept can't put Assault weapons in the hands of murderous drug cartels then say they had no idea anyone would get shot.

All's well with the above, PB, and it is an accurate assessment of the situation.

However, this is sidebar drama. This is as much stonewalling as is what Holder is being accused of. It will take how long to get this to a vote? And even if they move on it in this session, who notices before the summer break?

No, Holder and co. know exactly what they're doing. If they push back and drag their heals it will be the middle of the next presidency before anything big happens, and by then the American people will be distracted by other things: like the bankruptcy of the Federal Reserve, expansion of the Patriot act, and strict federal laws on what people can and can't eat.
