First, I think we need to identify IF said e-mails were sensitive government business vs. plans for the office x-mas party. Second we need to identify what rules/ laws were broken . Third any official utilizing unsecured personal e-mails for sensative government business should be canned

Best practices have always been that an employee using a private account for government business has to either print the e-mail (which rarely happens) or copy or forward the e-mail to the employee’s official government e-mail account for preservation. Those practices, which reflected the law as it existed BEFORE Mrs. Clinton was secretary of state, were codified by National Archives Regulations in 2009 (http://www.ecfr.gov/cgi-bin/text-idx?SID=86eb52e506c845f12d3c12cd60e8b207&node=se36.3.1236_122&rgn=div8), which required that any records created on private e-mail accounts must be saved to the federal-records system.

Heck I don't even represent the little voting district group I belong to, all maybe, when elections near, and the numbers swell up, all 10 of us. I remember once one starting using the newsletter to promote religious stuff till others of us pointed out that's not Tea Party concern, less taxes, more liberty, smaller government is it--so we even fight and argue amongst ourselves. Tea Partiers are a decentralized, grassroots bunch of people raising their voices is all. Not true. That is a myth.

There are scrubber programs and then you can overwrite the sectors. By the time a professional is done with her Server, the evidence is gone.

Those who used the old magnetic tape machines to record music know that when you recorded over an old song, with a new song, the old song was gone.
