Clinton Defies the Law and Common Sense

It is a misdemeanor punishable by imprisonment for not more than a year to keep “documents or materials containing classified information . . . at an unauthorized location.” Note that it is the information that is protected; the issue doesn’t turn on whether the document or materials bear a classified marking. This is the statute under which David Petraeus—former Army general and Central Intelligence Agency director—was prosecuted for keeping classified information at home. Mrs. Clinton’s holding of classified information on a personal server was a violation of that law. So is transferring that information on a thumb drive to David Kendall, her lawyer.

As things keep emerging, sooner or later the DOJ will HAVE to do something. It's not going away, especially during the 2016 election cycle. If the DOJ doesn't act it will reflect on the entire Democrat party who pushed for confirmation of Loretta E. Lynch. To me they will appear to the voters as corrupt considering they were willing to prosecute David Petraeus for keeping classified information at home, then allowing the Golden Girl to do the same thing without any ramifications at all. If they don't treat Hillary the same as they did Petraeus, the run up to 2016 will look a lot like 1994. "Democrat culture of corruption" mid-term election where the Republicans took over both houses of Congress, gaining 8 seats in the Senate and 54 in the House. This time they just might get a veto/filibuster proof majority + the White House.

I have never seen political appointees have so much sway over how the DoJ conducts its business. It is at the scandalous level today.

1. Mukasey is a politically biased Republican.

2. It does matter if they were marked classified because it goes to whether or not Clinton "knowingly" stored classified information in an unauthorized place , which is what the law requires.

3. The linked article is a month old. and obviously presented here for prejudicial reasons.

It does matter if they were marked classified because it goes to whether or not Clinton "knowingly" stored classified information in an unauthorized place , which is what the law requires.

It's the material......it doesn’t have to have that magic word classified on it. If the essence of it is a national secret, which if revealed could cause grave, serious or some harm, it is classified whether it is stamped classified or not. If the Secretary of State can't discern what is classified and what isn't, why wasn't she fired? Why would anyone think she could be President if she couldn't tell the difference? The Statute doesn't require classified material to be marked for the terminally stupid. It is expected at that level of Government that they know their job.

Micheal Mukasey served years as a judge. He knows law.

Secretaries of state deal in Classified top secret all day long. Those were not love notes, there is an official finding now they were classified. They know classified from non classified. In 1962, when I was then in the Army based in Germany, our troop movements were classified. Yet when we would arrive, the German girls got there almost with us to service the troops. Hell, most who handle secrets know one from something not secret.

Women can get more secrets than just about anybody else. When we went out on Army movements in the 60s, even our movements were classified. Why? The Soviets were a threat and we could not have them knowing our movements. Yet the German girls got the word around due to the Army guys telling them we were moving out on such and such a day. All they had to do was follow us. It is hard to conceal 20 thousand men movements of troops and equipment.
