SAN ANTONIO -- At just 14, Derek Lopez was shot and killed last November.

The shooter was a Northside Independent School District police officer, who said he saw Lopez fighting with another student and began chasing him.

Now months later, that is all that remains clear.

"It was literally one punch thrown, that was it," Lopez's lawyer, Wallace Brylak, said.

But Craig Wood, attorney for district, said it was much worse and Officer Daniel Alvarado felt the boy was dangerous.

"He was very concerned because he witnessed this violent attack," Wood said.

Both attorneys agree the boy ran and hid in a shed, but they do not agree on what happened next.

This is what happens when we allow our rights to be overthrown and commit to living in a police state with no oversight! My heart aches for this poor innocent child and his family.

Sounds bad but not enough details. The circumstances require reports from both sides. Thinking of the police state, when a guitar company is raided for using wood that no one cares about, yes police state.

The kid was expelled from Alternative School. We have some experience with
people like that! :o The cop and the student had morale issues.

NISD officials confirm that Derek Lopez was a student at the Bexar County Juvenile Justice Academy, where students go when they have been expelled from alternative school. Witnesses said NISD officer Daniel Alvarado tried to stop a fight between Lopez and another student. Officer Alvarado said he shot Lopez because he felt his life was in danger.

Lopez was known to be a troublemaker - he had had a troubled childhood, and had been expelled from one school and moved from many others before ending up at Bexar Juvenile Detention Centre in San Antonio.
