Hey DGUtley, did you realize that at 12:01pm the Senate takes a 5 minute recess for the changing of the guard? In that 5 minute time span before they reconvene, the President could go ahead and appoint John Garland to the open seat. I believe it would not be a lifetime appointment, but he'd hold the job until the next mid-term election.

One last parting shot for the President. Naw, he's too nice a guy.

Docthehun -- I few articles on this subject. The articles were split on whether the appointments were legal and whether it'd last until the end of the year or until Trump appointed someone. Yeah, Obama's too nice of a guy...

"In sum, we conclude that the phrase “the recess” applies to both intra-session and inter-session recesses. If a Senate recess is so short that it does not require the consent of the House, it is too short to trigger the Recess Appointments Clause. See Art. I, §5, cl. 4. And a recess lasting less than 10 days is presumptively too short as well.

I started the thread without posting a link to see what the Counselor, @DGUtley (http://thepoliticalforums.com/member.php?u=2019) thought off the top of his head, but he was way ahead of me and had already read about the topic. The off topic comments were expected. I'm also not surprised that once I established the validity of the thread, not another word was spoken. Simply, "par for the course".

As a footnote, I never watch Fox News and thus I didn't see the Judge on Fox and Friends.

Regarding "getting along" it takes two to tango.
