Ivanka Trump Sued for Alleged ‘Unfair Competition” by Clothing Rival

http://www.nbcnews.com/news/us-news/ivanka-trump-sued-alleged-unfair-competition-clothing-rival-n736041

Ivanka Trump's clothing company has been with a class action lawsuit by a San Francisco rag trade rival who claims she is cashing in on her pop being President of the United States.

Modern Appealing Clothing (MAC) says the First Daughter 's firm has also gained an "unfair advantage" from from her husband Jared "working for the President of the United States" and charged that President Trump, his trusted adviser Kellyanne Conway, and White House spokesman Sean Spicer have all helped boost sales of Ivanka Trump Marks LLC products.

"That advantage is specifically prohibited by the Constitution and laws of the United States and the law of the State of California," MAC claimed in court documents (http://tu9srvbirvvtnyr3d3cuc2znyxrllmnvbq00.g00.ibtimes.c om/g00/2_d3d3LmlidGltZXMuY29t_/TU9SRVBIRVVTNyRodHRwOi8vd3d3LnNmZ2F0ZS5jb20vZmlsZS 8yMDIvMy8yMDIzLUl2YW5rYVRydW1wU3VpdC5wZGY%3D_$/$/$/$/$)filed last week in San Francisco Superior Court and first obtained by the International Business Times.

Ivanka Trump and her "employees and agents have" been "exploiting the power and prestige of the White House for personal gain, including, but not limited to, piggy-backing promotion of defendant Ivanka Trump products on appearances at executive branch and other governmental events."

MAC is seeking a restraining order that would bar any Ivanka Trump label clothing or accessories from being sold in California.

"As a result of their unlawful acts, defendants have reaped and continue to reap benefits and illegal profits at the expense of plaintiff MAC and the Class it seeks to represent," the papers state.

This case is similar to the one where a restaurant is suing Trump for owning Trump Tower in DC and taking business away from his restaurant.

I don't expect that either case will go anywhere.

The gal who filed the suit needs to go after the snowflake who is heading up the #GrabYourWallet campaign that launched Ivanka's products into the limelight. That's the one who's responsible for citizens buying Ivanka's products at an increased rate.

This suit isn't going anywhere, anyway. The gal has to prove damages and just because Ivanka is seeing success doesn't mean the people buying Ivanka's products would have bought hers. Likely, hers simply don't sell well because folks don't want them anyway.

Like my attorney always tells me when I ask him if I should file a suit -- "You can sue the Pope for rape...but, you might not win."

Filing a lawsuit requires nothing but a sleazy lawyer going for a quick cash settlement. I was sued for sex discrimination by a woman I didn't hire. The person I did hire was a woman. The city where I worked agreed to give the woman suing $65,000 and a job plus pay attorney's fees. I refused and we went to court. After a week in court they got nothing.

So, filing a suit excites the idiots. Intelligent people wait to see the results. Cowards settle out of court with the settlement being a secret.

Standard Oil Co. of New Jersey v. United States

https://en.wikipedia.org/wiki/Standard_Oil_Co._of_New_Jersey_v._United_States

Standard Oil Co. of New Jersey v. United States, 221 (https://en.wikipedia.org/wiki/List_of_United_States_Supreme_Court_cases,_volume_ 221) U.S. (https://en.wikipedia.org/wiki/United_States_Reports) 1 (https://supreme.justia.com/cases/federal/us/221/1/) (1911), was a case (https://en.wikipedia.org/wiki/Legal_case) in which the Supreme Court of the United States (https://en.wikipedia.org/wiki/Supreme_Court_of_the_United_States) found Standard Oil Co. of New Jersey (https://en.wikipedia.org/wiki/Standard_Oil) guilty of monopolizing (https://en.wikipedia.org/wiki/Monopoly) the petroleum (https://en.wikipedia.org/wiki/Petroleum) industry through a series of abusive and anticompetitive actions.

The Court's remedy was to divide Standard Oil into several geographically separate and eventually competing firms.

Lawsuit Inside

I am not surprised to see such a suit. The act of suing somebody does not mean much, but if it actually goes anywhere it will mean a little more. One would think that the DNC would be a better choice in this case, since Democrats are the ones who are giving Ivanka the unfair advantage.

Remember this?

Stupid leftists bring stupid lawsuits, demonstrating stupid leftists should stay out of business.

This has a lot of merit. You did an excellent job of staying within forum rules here, since you did not call all leftists stupid, and you did not call anybody on this forum stupid. Stupid leftists, as opposed to average or smart leftists, should indeed stay out of business. I don't know the stats that would demonstrate that the stupid suits are only brought by the stupid variety of leftists, but I suspect that you are on the right track.

Well, you certainly can't ask a stupid leftist, can you?

:biglaugh:

One could, but that would be stupid. I don't even think it would make much sense to ask an average leftist either.

Did she say anything that was not true? I think that you have a legitimate complaint about the last little plug for her last statement about buying Ivanka products, but I don't think that this had much to do with why Ivanka's products are performing so well. Lefties are the ones who are responsible for the success of her products.

Constitutional purists don't seem to appreciate the Emoluments Clause. I guess article 6 isn't really part of the Constitution.

Emoluments clause? C'mon... This clause was out of concern from the 1700s that American ambassadors, while away, could be corrupted by gifts from rich European powers. It's not like Ivanka is getting expensive gifts from other countries that might lead her to corruption. The only folks who are giving Ivanka a great gift that helps her business would be the lefties right here in the USA who have launched her products to more success than she would have seen if lefties would have just left it alone. The emoluments clause is really reaching, and comes off as desperation. Have you looked at how often this clause has been used?

Please do not insult other posters.

Are you implying that members of our community here are stupid? His comment does not appear to be directed toward any posters here, unless of course you are taking a position here that some of our lefty posters here really are stupid. If I was a lefty poster and saw your comment, I would report you to a mod for insulting other posters. I don't like lefties, but I would not insult them the way that you just did here.

Could be, but the public interest is well served by asking the question.

Good point.

The interpretation is pretty clear.

This is an oxymoron when debating politics. The lefty interpretation probably won't be the same as a righty interpretation. I like to research to prove both a lefty and a righty interpretation.

You should read the op. This is being litigated under California's Business & Professions Code § 17200 (Unfair Competition).

What about the emoluments clause? I like a lot of your points in this thread, and have been trying to evaluate each of them objectively. I suspect that Ivanka is getting something out of being the first daughter, but I don't know if it is going to be tangible enough for the opposing political powers to lock onto. The whole thing appears to be politically motivated in the political war that is going on, so I am pessimistic towards both sides in this situation. My subjective side Thinks Ivanka is hot, and I want to see her benefit from all the political BS that is going on, but I can also appreciate your points when I look at the whole thing objectively.

It looks like you are only ignoring lefties, which means it will be hard for me to make the list. Just so you know, ignoring something voluntarily causes self imposed ignorance. I don't agree with any of the folks on your list, but I really value their input in the community. Without them, we would have an echo chamber here of righties singing to the choir. Silencing folks who you don't like, or ignoring folks you don't like is lefty behavior.

I did not "keep telling" her anything. That is my first such announcement to that individual.

Very good point. I don't know why he felt that he needed to enforce what he had to say with his big badge. I think your ignore list is a dumb idea and all, and I even agree with Chris poking you in the ribs about it, but if it needs administrative authority to support it, then it has no merit.

Starman, be advised that you have been placed on my list of people who I don't ignore.
