You don’t see a Kagan-Breyer-Ginsburg-Sotomayor-Thomas majority often in U.S. Supreme Court decisions, but today that quintet joined together to deal a blow to North Carolina Republicans. In the decision in Cooper v. Harris (https://www.supremecourt.gov/opinions/16pdf/15-1262_db8e.pdf), the eight-member pre-Gorsuch roster upheld a district court’s ruling that two congressional districts in North Carolina were unconstitutional racial gerrymanders, putting an end to one part of a six-year saga that began with redistricting in 2011.

I look forward to redistricting that ends safe districts for blacks.

I look forward to the Supreme Court actually enforcing their own rulings in Baker v Carr and Reynolds v Sims.

This was a step in the right direction.

Redistricting has been used for a very long time to create safe spaces for some of the dumbest people in the Congress. The Supreme Court cannot enforce anything. The enforcement role resides in the Executive branch.

Redistricting is a political issue. How could it not be? Political and financial power both come from redistricting. Democrats used redistricting to block out Republicans for five, six, seven, eight or nine decades. Where were the courts? Democrats created white-proof districts for their pet blacks to win time and again with no possibility of a political challenge. So now we can change that and remove the white-proof districts.

No, seriously. Gerrymandering law was decided 50 years ago. They just don't have the tools to evaluate redistricting situations. We haven't agreed on the yard stick.

Decisions on those yardstick criteria are percolating through the system as we speak. I've posted threads about the cases.

Notice the coalition for this 5-3 decision. Gorsuch won't affect this policy.

I have made no claims about this court's decision. I do see an opportunity to end the white-proof voting districts.

African Americans know that those white proof districts were constructed by white people to minimize the power of the minority vote. We call that gerrymandering.

Who would have thought that we would agree?

Double edged sword, recently in fla courts overturned their new redistricting plan, then the second plan was turned down. When the courts agreed to the third it negatively impacted african americans even more than the first two but the court said it was the fairest.

Actually long time Fla Rep Connie Brown who was recently indicted on many charges who also lost re election, was the main one democrats were trying to protect

That was my point, if they really enforce the law it wont always be the way you want it to be.

I am very much about enforcing the law, even if it negatively impacts my political beliefs.
