I think the basis is collusion and I'm guessing he would have to prove actual collusion.

I know what collusion is but I'm just wondering how Kaepernick is going to prove that his rights were violated rather than the NFL owners just deciding he no longer had the skillsets needed to perform at the level they were looking for. This could certainly set a dangerous precedence if he were to win.
