Congress and the Senate have a responsibility to check the executive branch, correct?
That's what is happening right now even though the executive branch is breaking the law and ignoring the power of Congress.

Yes, Congress has the power to check the executive. But that does not make them co-equal.
It remains to be determined whether "the executive branch is breaking the law." The House has yet to impeach, let alone the Senate hold a trial, so conclusions are far off and at best speculative at this point.
