    The claim will be against your home owners policy. Would they not fight the suit on your behalf since you are blameless? I hope you took photo copies of his ROC license and insurance cert when you hired him. I would think that it shows good faith on your part when you hired him to do your yard.

    My brother in law is an attorney and he said I dont have anything to worry about, he could easily defend it.

    Its the business owners responsibility to follow the law, have liability insurance and workers comp, etc

    To answer your question, I do not have copies of the original license and insurance affadavit he showed me 3 yrs ago.

    No Doc, I dumped my other landscaper for using illegal immigrant workers, this guy was doing a couple of lawns in the neighborhood and I stopped by his truck as he was doing one of them and told him to stop over and we can discuss it. I just asked for his license and insurance.

    Verbal agreements are always more difficult. You have no way to prove that he was expected to carry insurance if he lies unless you can bring in your neighbors who use his services and they also demanded that he prove insurance. Even that doesn't prove that you asked that he carry insurance. Hopefully, your liability limits on your homeowner's insurance will cover the loss of two toes. The average award for the loss of toes is about $100K - loss of the big toe is worth more than the loss of smaller toes. (You probably would have been better off with the guy who employed illegals - they are highly unlikely to sue.) Always get a written contract. Always. It doesn't have to be complicated, but it should cover the essentials i.e. John Doe agrees to maintain employer's liability and third party liability insurance and hold (your name) harmless in the event that the activities of John Doe or his employees results in injury to his employees or injury or damage to property for which he is found legally liable.
