    Ohio Supreme Court rules Miranda warnings not required by social workers. The Court held that a social worker’s statutory duty to cooperate and share information with law enforcement with respect to child-abuse investigations does not render social worker an agent of law enforcement for purposes of Fifth and Sixth Amendments to United States Constitution when social worker interviews an alleged perpetrator unless other evidence demonstrates that social worker acted at direction or under control of law enforcement.

    Isn't a social worker an arm of the government?

    Anyone who is employed by local state or federal govt is an arm of the govt but that does not give them police powers, only statute gives police powers, I agree with this law

    CPS acts like it is law enforcement. That is why I said in my previous post, lawyer up. If not, they will use your statements against you.

    I do not. CPS are police without badges and weapons. This violates the spirit of the 4th Amendment.
    Call your state legislators and insist they approve the Article V convention of States to propose amendments.

    Ok. Respectfully, I am not a lawyer. And I am familiar , familiar only with Miranda vs Arizona.

    But the fifth amendment is the fifth amendment. CPS, Social Worker or Police Officer. Why would Miranda not apply to all?

    An arm of State Government. And what I would define as a unsworn investigator. Point being, they are investigators whom represent the state they work in, as well as the states interest.

    It really matters when they fill out, write out , their documentation.

    Again, they are NOT law enforcement officers, they have no power of arrest or even to detain you. Any information they gleen from you is turned over to law enforcement to investigate. Sworn Law Enforcement make the arrests.

    What you are all forgetting is that ANYONE can give information that leads to your conviction as in your neighbor gleening information from you in conversation and then turns that over to police

    Parole officers are not required to read your miranda rights before they question you
