The NFL $#@!ed up here.
They did. They screwed up by not clearly prohibiting protests during the national anthem and then taking punitive measures against the players who defied the prohibition.
The courts may say they can't force them to participate, but they can prohibit them from any ostentatious displays during the playing of the anthem. They should have issued a blanket order throughout the league and enforced it without exception.

Call your state legislators and insist they approve the Article V convention of States to propose amendments.
I pledge allegiance to the Constitution as written and understood by this nation's founders, and to the Republic it created, an indivisible union of sovereign States, with liberty and justice for all.

I know it makes for good feelings to have pats on the back, but if you read his post, he didn't say anything about the Star Spangled Banner being the song he was referring to. He simply asked how many slaves and indentured servants sang along with their owners. Now, if you want to make the argument that since the topic was the National Anthem and you think he "implied" that the song in his response was in regards to the Star Spangled Banner, then you are opening up another can of worms in debate to include being able to process comments based upon what people are thinking. That will be a game changer if that is the route you want to go...
“Conscientiously believing that the proper condition of the negro is slavery, or a complete subjection to the white man, and entertaining the belief that the day is not distant when the old Union will be restored with slavery nationally declared to be the proper condition of all of African descent, and in view of the future harmony and progress of all the States of America, I have been induced to issue this address, so that there may be no misunderstanding in the future”
