    It is still assault. Whether she was hurt or not is not relevant to the guilt or innocent phase of the trial. It is relevant for the sentencing phase of the trial.

    But even if you were right, it wouldn't really change anything. A man taking a swing at girl's phone or anything else on her person is completely unacceptable and needs to be punished harshly.
