Thread: Yesterday My landscapers helper

    Yesterday My landscapers helper

    Yesterday, my landscaper and his helper was mowing, trimming and weeding. I was outside and I was looking at his helper, he was using a serated bladed edge trimmer in a very dangerous way. He was walking beside it and pushing it one handed, instead of being behind it using two hands, there are two hand handles on the back of it.


    Before I could get the attention of his boss who was on a mower he slices off two of his toes right through his boots. I run over to him blood is everywhere, I had my phone called 911 and considered putting a tourniquet on him and decided to have him put pressure with a towel until they come. Finally his boss sees something going on and comes over.

    First thing he says is omg im out of business, I looked up at him and thought WTF.

    Later after his helper is enroute to hosp, he tells me he has no insurance anymore. I said what?? he had shown me his license and insurance disclosure when I hired him, but he let it lapse a year ago. He said if he sues me im done. I said not only done but you will pay his medical bills.

    Then he says, hes 28 and he smokes weed all day long every day and his brain is sizzled, I asked what the hell did you hire him, he says to do him a favor he lives down the block from me.

    Anyway ill wait a couple of days and call him and tell him not to bother coming back im getting someone else.

    Ok, I said to my wife im liable to get sued also because it happened on my property.

    I learned a lesson, I will ask whoever I hire to produce his current insurance certificate every 6 months

    It is entirely defensible, just don't want to violate your policy provisions by failing to notify your insurer of a potential claim.

    Thank you. I keep a little box in my office that includes all of the thank you notes and cards that I've rec'd over 31 years of practicing law. Most of them start with something like: I was so upset when I first got sued....

    Having worked with labor attorney's for most of my professional career I can appreciate all the good that they do for society. Most people need to try to understand that most attorney's are out there trying to earn a living just like the rest of us and want to help people in their time of need. I actually worked with one attorney who argued cases before the US Supreme Court; he was an incredibly knowledgeable attorney to say the least and very respected by his peers.
