    You can read the rest at the link, NYC is a sewer of political corruption it always has been. I dont blame the lawyers who bring these friviolous lawsuits and milk hundreds of millions from taxpayers. I blame the Politicians.

    DISCLAIMER: The below statement is not intended to be racial or racist, it is a fact as I know it.

    The city used to just take any claims against police and pay them, claims of excessive force or racism, all a city lawyer had to do was threaten a lawsuit and the city gave them a few hundred thousand or a million or two it became quite lucrative to do that for lawyers and citizens. The city set the tone for all this, I dont want to make accusations that I cant prove but only a fool would not believe that some city politicians dont have several city attorneys giving them big gifts.

    NYC isnt the only city in the country being torted to death its a great living for lawyers with little risk




    New York City is being tort-ured.


    The Big Apple is drowning in so many frivolous lawsuits — over everything from food packaging and advertising to the design of retail Web sites — that the city’s court system has become one of the nation’s worst places for civil justice, a damning report out Tuesday reveals.


    The American Tort Reform Foundation will give New York City the dubious distinction of placing No. 3 on its annual list of “Judicial Hellholes” where plaintiffs lawyers run amok with the help of accommodating judges and do-nothing lawmakers.


    The report, a copy of which was provided to The Post in advance, turns up the heat on the city’s court system, which has previously come under fire from the ATRF for the “brazenly plaintiff-favoring ways” of a special court for asbestos-related, personal injury suits in Manhattan Supreme Court.


    ATRF President Tiger Joyce said many cases in the report involved “a number of areas of litigation where really, when you boil it down, there really isn’t any particular kind of injury.


    “The theory of the case is that somehow people have been harmed, when it hasn’t been demonstrated,” he said. “This new trend is something that we are obviously quite concerned about.”


    In fact, the only places deemed worse than New York City for irresponsible tort filings are entire states: California at No. 1 and Florida at No. 2.


    The report states that the cost and compensation paid in the US tort system totaled $429 billion in 2016, accounting for 2.3 percent of the US gross domestic product.


    The ATRF report cites a 2017 study that found 22 percent of all “frivolous food lawsuits” nationwide were filed in the Big Apple, primarily over claims that food packages aren’t filled to capacity, or that products don’t live up to advertising that they’re “natural.”


    In one case, a Manhattan federal judge tossed a class-action suit alleging that consumers were tricked into buying Junior Mints because the candy was “packaged in a box with more than one quarter of the box containing air.”


    Judge Naomi Reice Buchwald said allowing the suit to proceed would “enshrine into the law an embarrassing level of mathematical illiteracy.”

    Under federal civil court rules plaintiffs can be forced to pay defense's costs if the judge determines (after a defense motion and plaintiff response) the case had little to no merit. If this was used more (and by states) a lot of these frivolous cases would go away.

    New Orleans us to fight cases forever and if they lost tell the plaintiff to get in line- a very long line and wait....

    I am stunned and dismayed by the last few threads and posts on police in the forum.

    I will no longer participate in any police threads, I retired a Police Captain with 28 yrs of spotless service, I saved many people and helped many many more. I did my job professionally and with caring and I tool ALOT of badguys off the street and helped to give others justice for acts against them. I am damn PROUD of being a Police Officer and Im proud of the job the lionshare of all Police Officers do every single day. The many thousands they save the many hundreds of thousands of damn good honest Law Enforcement officers.

    There are some on this forum that are so uninformed some so disengenuous and some exaggerate and expound to absurdity, that there is no need for me to participate any longer, its apparent that all of you know all about Law Enforcement, you know all the laws that govern Police, you have all the answers, you know precisely what Police Officers are allowed to do and what they are not and I of course do not.

    I called both my son in laws earlier and we talked and both of them combined have 37 yrs active working experience and after asking them some questions, I feel certain that ive responded to these threads, honestly, correctly and my one son in law, said Pop wth are you doing just ignore them, we dont pay any attention to any of that $#@!, what all those kitchen table lawyers collectively know wouldnt make a decent sized pile of $#@!, I laughed and knew he was right, I said Lieutenant you are going to be a better Captain than I was.

    Ill take my leave, I have no animosity for any of you, I understand some people have had what they believe is bad experiences or feel they were mistreated. Its ok, Ill get my check deposited whether you like me or not

    I read your post with interest and I don't doubt the authenticity of what you say. It's derived from a lifetime of experience in the field in which you specialised.
    My having said that, perhaps you should reflect on the experience of others on this forum before delivering your verdict on their motives.

    Our justice system needs serious reform. And IMO, the civil justice system is even more screwed up than the criminal side. AND I'm talking about a nation that calls itself the "land of the free " while incarcerating more people than anyone else, many of them for victimless crimes. Enforcing the statue Peter talks about in post 2 and making it applicable to the plaintiffs law firm would be a start.
    Doing something about the class action cash cow would be another step forward. If your firm actually harmed millions of people ( i e tobacco) let them face millions of lawsuits, , instead of a few. O(r instead of the soul selling deal the states made with big tobacco called the MSA. Which, although it offers no direct benefits to individuals seemed to stop the lawsuits.

    The politicians are the lawyers. And the lawyers are the ones telling the politicians to make it easier to sue people. So it's kind of hard not to blame the lawyers who bring frivolous lawsuits for frivolous lawsuits.

    I believe you but I do sometimes wonder how many pot bust you made and whether you sometimes feel bad about that undeath all the "pot is the devil" post.
    This is not meant to offend you. When I did direct addiction services not all clients did well and once in a while I think about those who didn't .
