    Federal judge rules Obamacare unconstitutional






    (Reuters) - A U.S. federal judge in Texas ruled on Friday that the Affordable Care Act, commonly known as Obamacare, is unconstitutional, a decision that was likely to be appealed to the Supreme Court.

    U.S. District Judge Reed O'Connor in Fort Worth agreed with a coalition of 20 states that a change in tax law last year eliminating a penalty for not having health insurance invalidated the entire Obamacare law.

    O'Connor's decision was issued the day before the end of a 45-day sign-up period for 2019 health coverage under the law.

    About 11.8 million consumers nationwide enrolled in 2018 Obamacare exchange plans, according to the U.S. government's Centers for Medicare and Medicaid Services.

    The coalition of states challenging the law was led by Texas Attorney General Ken Paxton and Wisconsin Attorney General Brad Schimel, both Republicans

    It may not make it to SCOTUS. If the appeals court over turns the trial court, SCOTUS may not take it up. Roberts likely won't vote to hear the case and you need 4.

    There'll be hell to pay, but he's right. Since the individual mandate was scrapped, Obiecare was basically gutted, there's no teeth in the law. And screw Roberts, the coward defined it constitutional as a tax, only and never ruled on the platform as a whole. Congress was right to deregulate it as a tax.

    It is an interesting position: The individual mandate survived a constitutional challenge because Roberts gymnastically decided the Congress-labeled penalty was a tax. Said mandate is necessary but the tax is now gone. The judge May be right. I will pull his order when I get to the office this am.

    Federal Judge Strikes Down Affordable Care Act As Unconstitutional

    A federal judge in Texas issued a ruling Friday declaring the Affordable Care Act unconstitutional, apparently setting the stage for another hearing on the health care law by the U.S. Supreme Court.
    The ruling by U.S. District Judge Reed O'Connor invalidates what's commonly referred to as Obamacare nationwide, and casts into doubt the survival of the law on the eve of the deadline for tens of millions of Americans to sign up for health care coverage in 2019.


    The ruling comes in a lawsuit brought against what was one of the major domestic achievements of the Obama administration. An alliance of 19 Republican attorneys general and a governor led by Texas Attorney General Ken Paxton challenged the law.
    As NPR's Alison Kodjak explained on All Things Considered,
    "The lawsuit had to do with whether when Congress last year repealed or eliminated the penalty for not having insurance — it was a tax penalty for people who didn't have insurance — whether that meant the rest of the law didn't apply anymore. The court case argued that all of the pieces of the law were dependent upon each other, so by eliminating the penalty the rest of the law fell apart. The judge agreed with that opinion."

    In his 55-page opinion, Judge O'Connor said the debate over the ACA's interlocking provisions is "like watching a slow game of Jenga, each party poking at a different provision to see if the ACA falls."
