    Trump has intervened to get Gallagher to less restrictive pre-trial confinement.

    We ask our Spec Ops troops to do a lot. I am not really upset about this teen's death. We need to stop eating our own- at least outside of clear cut misconduct.

    Trump’s Saturday morning tweet came after a Fox News segment that aired at about 7:45 a.m., during which Gallagher’s brother thanked the president and various anchors from the network that have advocated on behalf of his family — including “Fox & Friends” hosts Brian Kilmeade and Steve Doocy. Trump tagged "Fox & Friends" in his tweet.

    “I have to say, I have to thank you and Brian and Steve, and particularly Congressman Ralph Norman and especially President Trump for exercising common sense and human decency in allowing my brother to be relieved from a prison of convicted sex offenders so that he can actually meet with his lawyers, see his family, see sunlight and be treated like a human being ahead of his trial so that he can properly prepare to defend himself,” Sean Gallagher told Fox News host Pete Hegseth.


    “At this point, we're pretty confident the White House is going to today make something happen,” he added.

    Navy SEAL Edward Gallagher’s lawyers say military prosecutors spied by hiding tracking software in emails

    If this is true it may be a basis to dismiss the case.

    Lawyers representing the decorated Navy SEAL accused of killing an injured ISIS prisoner of war in Iraq are now accusing military prosecutors of installing tracking software in emails in an apparent attempt to find out who is leaking information to the media about the case, an explosive report claims.

    Edward Gallagher’s legal team caught on to the alleged scheme last week after they noticed an unusual logo of an American flag with a bald eagle perched on the scales of justice beneath the signature of a message sent to them by one of the prosecutors, according to the Associated Press. It was not an official government logo and the lawyers reportedly found suspicious tracking software embedded inside it.


    "I've seen some crazy stuff but for a case like this it's complete insanity," attorney Timothy Parlatore told the Associated Press. "I was absolutely stunned... especially given the fact that it's so clear the government has been the one doing the leaking."

    Update: the prosecutor was removed by the judge for illegally tracking the defense team's email.

    I don't know how this cures the Constitutional violation. If the Chief is convicted an appeals court will likely toss it.

    The prosecutor will be lucky if he is not suspended / debared by his state's highest court.

    Judge reduces maximum penalty in case against Navy SEAL.

    I am not sure how this is suppose to cure the prosecutor misconduct.

    A Navy SEAL accused of fatally stabbing a wounded prisoner of war caught a break when a military judge, citing alleged spying by prosecutors, reduced the maximum penalty he could face.

    Special Operations Chief Edward Gallagher’s trial, which was set to begin Monday, has now been delayed a week. He had faced life in prison without parole.


    Instead, Gallagher could now face life in prison with the possibility of parole, Capt. Aaron Rugh ruled.


    But the judge refused to dismiss the case against Gallagher, who pleaded not guilty to the 2017 murder of an injured teenage militant in Iraq, as well as shooting unarmed civilians in Afghanistan.


    The decision by Rugh was the latest rebuke to prosecutors in the case, who were accused of tracking e-mails sent to Gallagher’s lawyers in an effort the defense characterized as “spying.”

    He was found guilty of taking the photo with the dead kid. He has already served more time pre-trail than he could get with that charge. The big question is whether he will get a punitive discharge which may effect his retirement- I am not sure if he has 20 years yet.
