Well, think what you will, but I don’t see any realistic chance at all that Trump keeps the shutdown going after launching a national emergency declaration. That’s what he does when he gives up and just signs off on the government reopening without congressional funding. I just don’t think there’s any realistic chance whatsoever he keeps the government shutdown anyway. It’ll be fully reopened in the coming days/weeks, one way or another.

Of course it’ll be challenged, but given this court and a basic read of the relevant case law, it’s about 90% guaranteed the SCOTUS will uphold the wall. It’ll take longer to build it, for sure, but it’ll come. It’s just the only option if congress won’t fund the wall, and one that he looks to be gearing up for.

The Congress gave the President statutory authority to declare a national emergency and to act. There is no legal issue to resolve. This is a political issue. The Congress wrote laws giving the president the authority to act. The Congress can also reverse the President. The court has no role to play. None.

The President has plenty of choices.
