    I believe I know the answer to the question, but if by this time next week, the Congress and Trump have reached an agreement, the border wall gets funded and federal workers get paid, including backpay, can the Congress be sued in the names of Pelosi, Schumer, McConnell and other principals for damages and all sorts of FREE stuff, and run out of Washington on a Amtrak rail??

    The answer is who cares? You and I pay for it anyway.

    Certainly. Whatever wall or barrier is constructed will have to be continuously maintained.

    It would be very hard for a court to strike down a presidential emergency declaration. The statutes do not define emergency so the President has very wide authority. And a court cannot create a definition that is absent from the statutes.
