Difficult to judge without reading the actual postings, but it does seem like a stretch. Anyway, this is how laws get struck down or amended; legislators frequently create laws that are at odds with the Constitution and American legal traditions, and it is cases such as this that provide the courts with an opportunity to right the ship.

Given the ability of the courts to fabricate entire civilizations out of conjecture this law can be used to shut down any postings on Twitter. Suppose I start a blog to discuss why I think Harley Davidson motorcycles are piles of whale dung, could that be interpreted to mean I am trying to incite Harley owners?
My guess is the hags were rated lower on the scale were the ones that pushed this. Remember Facebook started as a way to rate the chicks at Harvard. This is no big deal.
