However the termination of a pregnancy is a special case; not only has medical science failed to provide a consensus on exactly when human life should be considered to have begun, abortion - or rather, the legal banning of it - involves an intrusion by government into the bodily integrity and privacy of a woman that does not exist in the case of murder, capital punishment, etc. From a legal standpoint, to imbue a nonviable cluster of cells with personhood is a legal fiction too far.
