The question of birth male transgenders competing in women's athletic events is complex. I don't have a simple answer on that one Rationalist.

These instances are not common. They SEEM more common because the hard right make 'em a national story every time they come up.

Offhand, I would leave it to school districts, coaches, universities, etc etc etc to make those decisions.

I would agree that local authorities should make those decisions, but a federal law that opens the door to discrimination lawsuits in these circumstances ultimately means that these decisions won't remain local or outside of a courtroom.

There are other concerns as well. If a business owner wants to limit men's and women's rooms at their place of business to people who have the matching genitalia, that might be a problem with a law like this in place as well.

I'm sure you remember the media hoopla over North Carolina's state government trying to enforce a blanket version of this kind of policy. At the time, only private entities got involved with boycotts, but this equality law would open the door for federal intervention.

There are also concerns with locker rooms at gyms having to deal with trans people. I'm sure a large percentage of cis women don't want a trans woman in the same locker room (particularly a pre-op one).

Gay rights are generally much simpler to define and enforce, but trans people basically make things difficult for society to function in any remotely normal way.
