    As bad as the Obama-care case was, should it be followed, Congress can no longer use the Commerce Clause as a reason for most federal laws.

    Non-delegation is a different issue. All legislative power is given to the congress. It is not a shared power. And yet, today almost all the laws we live under and are subject to were written by unelected bureaucrats in Executive Branch agencies and a handful of judicial branch activists.

    With a very few exceptions every one of those Executive branch agencies is unconstitutional. Every garden variety progressive believes as you do.
