    Second degree murder is an intentional killing that was not premeditated. This killing was intentional and it was not premeditated. Therefore, it meets the definition of second degree murder.

    You should blame the friggn'district attorney who was charging to high for the failure to get a conviction.

    The charge should have possibly been man slaughter. Ask the legal beagles here for the difference, but I'm pretty sure second degree did not fit the circumstances.

    Now that I think about it, it really wasn't all that surprising. Since you have a penchant for blaming the cops first, no matter what the situation. Training schmaining.     He was charged with manslaughter and acquitted.... Yet one more example of the militarization of police with complete disregard for the inalienable rights of our citizens. Particularly disgusting that this guy is gonna get a medical pension for this.
