Second degree murder is an intentional killing that was not premeditated. This killing was intentional and it was not premeditated. Therefore, it meets the definition of second degree murder.
I blame the coward who killed a man for no legitimate reason.You should blame the friggn'district attorney who was charging to high for the failure to get a conviction.
The charge should have possibly been man slaughter. Ask the legal beagles here for the difference, but I'm pretty sure second degree did not fit the circumstances.
