Thread: Senators File an Enemy-of-the-Court Brief

    When I was a kid, these billboards dotted the countryside, largely in response to the high court's ruling in Brown.



    I've been listening to politicians and pundits bad-mouth the Supreme Court my entire life - threatening impeachment, charges of treason, etc., and for the most part those threats have come from the Right.

    In any case, the Congress is granted broad discretion in the matter by the Constitution. We have had as few as five and as many as ten justices in our history. If I recall correctly, Andrew Jackson was able, with the help of Congress, to reduce the number of justices from seven to five just in time for the inauguration of his political enemy, J.Q. Adams.

    Where we are now, however, such threats are empty. Although the justices themselves would probably welcome the increase in their numbers because it would greatly lessen their workload.

    In New York State Rifle Assoc. v. City of New York, 5 senators filed an amicus brief with SCOTUS. This brief essentially warns the court that if they rule against the City and its draconian anti-2nd Amendment law that the Congress would restructure the court and pack it with anti-gun radicals.

    This is outrageous and I hope it becomes a main issue in 2020. Although SCOTUS may be able to dodge the issue on jurisdictional grounds, I would think that doubtful since they agreed to hear the case. Even if they do, how is the Court going to handle being blatantly threatened by these senators?

    They remain unconstitutional. FDR conducted a counterrevolution that ended the original Constitution.

    Andrew Jackson (7th Prez)? John Quincy Adams (6th Prez)? I am eager to hear more. I own three or four books on Jackson. Maybe it is time to read them.
