    That isn't self defense. Not sure how the stand your ground law will effect this (I never practiced in a jurisdiction with that law).

    I cannot see how he could claim that he was standing his ground. I don't think he can legally claim that since the criminals were fleeing when he came out with his AK-47. He was bruised by them and angry but he certainly was not defending himself. You can't shoot someone in the back and claim self defense, especially when no gun was found in that car.
    I can understand how he felt...enough is enough, so I don't fault him ethically.

    Right. As soon as the nogoodnick breaks off his attack to flee you become the attacker if you continue to engage. If the attacker was randomly shooting at people as he fled, you can continue to engage him under a defense of others theory.

    With the way the laws are, he is going to have a hard time proving self defense.

    Yup, that is exactly the way they shoot.
    Like they are shaking the bullets out of the rifle.
    Little of those movements were actual recoil.


    He is a pretty big guy himself.
    I wonder why he did not just go over and beat the crap out of him.
    No need for an ineffective rifle.
    Though it sticks in my craw every time I have to call the AKM a "rifle".

    I remember years ago around here there was an immigrant family but became citizens that bought an old country store. The dad, mom, daughter and son. The dad and mom in their late 50's nice couple. That night the mom was running the register, daughter not there, son and dad in the back stocking. Two men came in with guns and robbed her, then shot her twice, the last bullet in the head. There son runs out of the back and they shoot him, he takes cover. The dad runs out with a gun and starts shooting. He also gets shot but manages to shoot one rushing towards the door to leave.
    His wife was dead at the scene, son died at the hospital and the cops arrested the old man, wasn't even allowed to attend the funerals becasue they claimed he shot the last one fleeing. There was an outrage here and they dropped the charges. But who in their right mind would arrest that old man.

    They never should have arrested him. Glad public outrage got him free.

    Poor weapon control and technique by the crazed shop owner. Strike one
    Shooting in public at a fleeing man who spilled a trash can and yelled at the shop owner. Strike 2
    Hitting the man in the back and paralyzing him. Strike 3

    The shop owner will be criminally sanctioned to some degree.
    And civilly penalized for big bucks IMO.
