I don't think many private sellers would bother with background checks especially if they are selling to family or friends. I was part of a group of 3 cops, 1 DEA agent and me who sold / traded with each other, no problems.

The point is to hold the threat of a serious punishment over the heads of honest citizens in order to get them to do as the State wants them to do. As D says, that's what most laws come down to - controlling people's actions.
Is a requirement for a background check on private sales an infringement of the Second Amendment? To be honest, I'm undecided. As a lifelong contrarian by nature, it irks me; it inconveniences thousands of honest, law-abiding citizens in an attempt to deter a handful of people who are already committing crimes, of one kind or another, with the weapons they're buying or selling. It makes far more sense to me to increase the penalties for those who purchase firearms in private sales and then violate existing laws by transporting them across state lines and/or committing crimes with them. The State should focus its punitive energies on the actual criminals, rather than trying to make ordinary citizens into criminals.

...so if I go to Virginia and sell three...count em'...three... guns to Mike, or we both swap one gun for another, we are required by this new law to perform background checks on each other?
I say...UNENFORCEABLE.
Anything you do as a private sale is unenforceable.
How many times you do it is also unenforceable.
Yet another bureaucratic law meant to make those on the left feel good and make them think they have actually done something.
...when in fact, they did nothing at all to stop gun violence.
The honest and hard working citizens of Virginia are NOT the ones committing those crimes.
...and as we all know....this has nothing to do with crime.
It is 100% about POWER.
Citizens with the means to shoot back are a problem for them.

Remember the " Saturday Night Special " handgun bans and attempted bans of the 60's ???
Just like this one, the term is not clearly defined.
It was so vague some even included the excellent and well-made Walther PPK from Germany.
For everyone else, this is the famous James Bond gun.
This is their tactic. Throw out a broad, scary generic name for a gun so you can scare people into banning it.
When actually, few weapons fit the narrow definition in the first place.
My definition of an "assault rifle " is...
1. Used and issued by a nation's military...AND...
a. is select fire. You get to select if you want full auto, burst, or semi-auto.
b. it fires an intermediate round. Not a full power rifle round such as the 7.62 NATO, or the Russian 7.62R....and NOT a pistol caliber either. It is INTERMEDIATE in power between the two.
c. ect...ect...ect... with other technical stuff.
