The congressman presumed elect said he wanted to expand the court- it wasn't editorializing.
"Our democracy is under assault, and the Supreme Court has dealt many of the sharpest blows. If Democrats want to do something about that, expanding the court is our only option,"

FDR threatened to pack the court in Feb. 1937 because SCOTUS was finding all of the New Deal legislation to be unconstitutional. [Because it was.] So he threatened to pack the court from 9 to 15 and in the 1937 Court term New Deal legislation started to past SCOTUS muster- they discovered a new theory: the Commerce Clause allows congress to do anything whatsoever it wished to do.

I already answered your hypothetical in response to Newpublius. He said he wants to expand the Court. Does he want to do that to give liberal justices an advantage? Obviously. But the OP claimed he said that’s what he wanted, and THAT is editorializing, because he never said that. We just assume (correctly) that it is what he wants.

Silly me. Here I was, thinking that the congressman's INTENT was more important than whatever PC words he chose in order to slightly hide his intent (without being able to fool anybody, by the way). Guess not, guess the words are more important, huh?
