According to lawfarelog.com "Former Deputy Attorney General Sally Yates located the cutoff more precisely at the 90-day instead of the 60-day mark."
Since this is a unwritten rule, I have to admit there may be no requirement at all, since apparently the DOJ had once considered and declined to codify it.
However, at some point earlier this year (Jan or Feb?) Barr breathed life back into the policy when he ordered that all such politically sensitive actions get his approval. So I guess its not ok for Durham to interfere in the election --that is, unless William Barr thinks its ok for Durham to interfere. I wonder if Barr will still try to feign respect for the 60-day rule (the 90 day deadline has already past) by releasing it as close to the 60 day limit as possible
