    Post Fog Line: Part of the lane or not?

    Oral Argument Preview: Where Do We Draw the Line: Does Driving On, But Not Across, a Marked Line Provide Reasonable Suspicion To Support a Traffic Stop? State of Ohio v. Ryan Turner
    This is an interesting issue. On August 18, 2020, the Supreme Court of Ohio will hear oral argument in State of Ohio v. Ryan Turner, 2019-1674. At issue in this case is whether a police officer has reasonable suspicion to stop a motorist for a marked lane violation when a motorist drives on, but does not cross, a marked line.

    Yeah, but in foot ball if you break the plane of the goal( in other words touch or cross any part of the line) it is considered a touchdown and you are OUT of the field of play.

    Several years ago I was in George for a motorcycle rally in the hills around Hiawassee. The county mounties were out in force pulling us over if we touched the line on a curve. The fine was $25.00 and you just mailed it in to the judge. It was said the back roads were like a Baptist Prayer Meeting, there was no praying or singing but they sure were taking up a collection! They also had some downhill sections where they lowered the speed limit from 40 to 20 and hid the signs behind a stand of trees on the side of the road.

    I think that there can be many legitimate reasons that people might have to drive on the fog line. For instance to avoid something on the road like debris or a pothole, or because the vehicle in the adjacent lane is drifting to the right or because that portion of the road is suddenly uneven and it causes the vehicle to move to the right. Drifting to the right one time doesn't in and of itself imply impaired driving, so I say no to the question posed.

    On two related topics:

    The latest thing I have seen on the road are people who stay one or even two car lengths away from the stop line when they pull up to a red light. Has anyone else noticed that? Its like a new thing, and very annoying because sometimes the light does not turn. Whats up with that.

    The other latest thing I have noticed is that people think they can just stop right in the middle of anything and disrupt traffic if they missed a turn. Instead of just going on and turning around at the next opportunity, apparently people now think that missing a turn is justification for crossing three lanes at a left angle, causing accidents, driving over medians, or whatever, to get to that turn they missed. Whats up with that.
