Well, this natural right now is granted. Before it was banned (same-sex marriage). So, this natural right was denied, banned, therefore it is positive.

Gotta be honest, if you are gonna say its unconstitutional then you should be able to marry to multiple partners.

And what if the rest of us? Why can't I leave my SS which I've paid through my payroll taxes all my life to whomever I want? No. I am forced to get married to receive this benefit. Why can't the person I love see me at the hospital or get information on me unless he comes in with me or I give it to him? Why can't I just tell doctors he's allowed to know? Because the state now gets to determine the level of my relationship.

Well, it happens when is the state based in conservative ideologies. The society demands or demanded it.

Now, this conservative societal structure is being transformed. Give time, maybe it will become as you would like it will be. But same-sex marriage is a step openning freedoms in the marriage topic.
