None include the death penalty. Under military law, the punitive articles that say death in time of war, means declared war. We haven't had one of those since WWII.

PTSD and intent will all be closely examined. There are quite a few articles that the lad could be charged with. Some include the penalty of death. Most do not.

All in all, were it my life on the line as to how this will end, I would say he gets a pass out of the army with perhaps a 209 discharge or maybe a dishonorable discharge and left alone. Some say his time with the Taliban equals prison time. Judges will study this and much more as will the defense attorney and prosecutor if it comes to that.
