If you agree that both law and social institutions are rooted in traditions, culture, and history then the argument is over. Roman law indeed originates from Roman society in so far as it originated from Roman mores, from Roman folkways, and from the Roman cultural horizon. There is no indication that a gay marriage was even conceivable to the ancient Romans. Case closed.

Now we know you reject the notion that social issues be decided at the state and local level. I'm still trying to get over that sudden and complete reversal.

Furthermore, the reason an unprecedented and inane concept like gay marriage could become a veritable civil rights crusade is because we have become increasingly detached from our traditions, culture, and history. The hyper-individualism, materialism, and self-absorption characteristic of western society erodes social bonds, destroys traditions, and undermines historical communities leaving modern men isolated and defenseless against the forces corporatism [sic] that so many us complain about. It should come as no surprise that marriage is perceived less as an institution designed to preserve continuity and to raise the next generation but one designed for our own self-fulfillment.
