This ruling in a court in Germany may cause a lot of discussion in certain quarters --- that circumcision amounts to GBH unless the child is old enough to make an informed decision .
My understanding is that the procedure was first introduced as a good health measure , but now the sorts of conditions that made its introduction sensible and far sighted , have disappeared -- certainly in so called first world economies .
On these grounds it seems to me that if this ruling is upheld , it should be introduced -- in countries as appropriate .
I suffered this small indignity as a Gentile ( there were consequences which I shall not reveal ) but I am much more interested in Jewish comment -- assuming there is any . I have a feeling that for this people the act represents more than a sensible defence against dirt and disease . But without checking it out , I don't know the details .
This was reported on 27/6/ in the on-line version of Al Jazeera and in the European section .
Please note that I have not attempted to make any sort of jokes --- good , bad or indifferent . So hopefully nobody else will try to stitch themselves .
Circumcising young boys on religious grounds amounts to grievous bodily harm, a German court has ruled.
The regional court in Cologne, western Germany, ruled on Tuesday that the "fundamental right of the child to bodily integrity outweighed the fundamental rights of the parents", a judgement that is expected to set a legal precedent.
"The religious freedom of the parents and their right to educate their child would not be unacceptably compromised, if they were obliged to wait until the child could himself decide to be circumcised," the court said.
The case was brought against a doctor in Cologne who circumcised a four-year-old Muslim boy on his parents' wishes.
A few days after the operation, with the boy bleeding heavily, his parents took him to a hospital. Prosecutors then charged the doctor with grievous bodily harm.
