Bergdahl's lawyer, Eugene Fidell, said Wednesday at noon his client was told he would be charged with "desertion and misbehavior before the enemy."

There will be an Article 32 hearing on April 22 at Fort Sam Houston to "decide if there's probable cause."

Fidell said he did not know if the military would take Berghdahl's time in captivity into account before handing down any decision about his client.

"I assume that anyone in a position of responsibility would understand that is an important mitigating factor," Fidell said.

Bergdahl was released last year in a controversial prisoner exchange for five Taliban commanders held at Guantanamo Bay, Cuba.

NBC News first reported in January that Bergdahl was likely to be charged with desertion.

The Army also had the option of filing the lesser charge of going absent without leave, or AWOL.

The Army planned to provide details at a 3:30 p.m. ET press conference at Fort Bragg, North Carolina. A lawyer for Bergdahl told NBC News earlier Wednesday: "We'll have comment later today."

The military began investigating after Bergdahl was repatriated and returned to Fort Sam Houston in San Antonio, where he was given a desk job.

Investigators questioned Bergdahl for two days last summer.

If convicted, he should be shot. Soldiers died searching for his sorry a$$.


President Obama was very wrong throwing his support behind Bergdahl without knowing all the facts, but Obama does that quite often.

Five, count them, five high ranking terrorists were exchanged for that loser.
