    Here is another article that describes the two lawsuits that TransCanada is pursuing.

    After taking a blow by the Obama administration, TransCanada Corp. is launching a two-pronged legal attack on the president's rejection of the Keystone XL pipeline that some attorneys say may pay off.

    The Canadian energy company yesterday announced plans to challenge the administration on two fronts. TransCanada said it's seeking $15 billion in damages from the U.S. government under the North American Free Trade Agreement, claiming that the rejection of the proposed pipeline was political and deprived investors of billions of dollars sunk into the project.


    The company is also suing the administration in a federal district court in Texas, alleging the president surpassed his constitutional authority by vetoing the pipeline.
    I don't think the second case will prevail.

    i agree but the suit regarding NAFTA will be interesting. Has it ever been done before that you know of? I side with Canada on this. Obama made them jump through hoops, and strung them along for years.

    I don't know if there has been a lawsuit under NAFTA. Let me look....

    Apparently yes. This article says Canada has been the target 70% of the time.

Over two decades later, the ISDS [Investor-State Dispute Settlement] process in NAFTA has become notorious, more so elsewhere than in Canada, though this is changing…. [Of late] foreign investors targeted a broad range of government measures in North America—especially in the areas of environmental protection and natural resource management…. Canada has faced 36 ISDS claims, more than any other developed country in the world, and since 2005 we’ve been hit by 70% of all NAFTA investor lawsuits.”Scott Sinclair, CCPA
    So there were 36 claims as of 2005.
