I guess if there were no government limitations on premium investment, any insurance company could invest their premiums as they see fit. However in defense of those legal limitations, there is good reason for them. Investment in higher risk vehicles can be feast or famine. If you are an industry that is intended to avoid catastrophic loss, then you need to be solvent. If all of your investments are in economically sensitive funds then any economic reversals will take you down and leave your policy holders with worthless coverage.

No. While company leadership would be responsible for the demise the real losers would not be the companies, it would be all of the people who paid their premiums to have coverage when they need it. No one cares if a fat cat company goes down, they care if it takes down vulnerable and responsible citizens who spent their hard earned money to ensure that they were protected.
