Actually, that is the place where civil and criminal law overlap. If there is no intent, then it is viewed as a civil tort. If there is intent in the sense that the negligent party is willfully blind to the potential harmful consequences, then it becomes criminal. The phrase "wanton disregard" is often used.

Not particularly. I have read some of the codes and penalties, but to be really familiar I would also have to read a raft of pertinent case law. I could do so, but without examining the content of the emails in the context of the law, it still be supposition.

Intent is not an element of most of the laws governing classified materials. Crooked Hillary, while using her unauthorized server broke at least three laws, all of which have large fines and jail time. Hillary should rightly die in prison, penniless.

What is it about Mrs. Clinton which forces people to go to the mat in defense of her criminal / illegal acts?
I have my suspicions as to why she is considered to be above the law.
