    Rebellion is in the air.

    Even as Mr. Obama was handily re-elected to a second term this month, Republicans won their 30th governor’s seat. Now, many of the same governors who tried and failed to block the president’s health care law in court are being charged with putting it into place. This week, as they gathered here for a meeting of the Republican Governors Association, they sought and won an extension of a Friday deadline to begin to decide how they will comply with the law.
    Paul Revere is riding steedily across the states of affronted Republican governors.

    Will they abide by the law or throw themselves into Boston Harbour?

    (There may be a few historical inaccuracies there. Exercise parental control.)

    If the states were to openly defy the federal courts--and do so unabashedly, and as frequently as they desire--it would be a matter of no consequence as to what some court might pontificate (yes, including the SCOTUS).

    My own preference is rather straightforward: If the individual states were simply to declare that The Ultimate Authority for deciding the constitutionality of any issue is the state supreme court--and if they were to simply ignore the federal courts, completely--the individual states would cease to be under the thumb of an overweaning federal government...

    Why not just rely on the principles of federalism that our Founders' gave us?

    Actually, with regard to the matter of each state's individual sovereignty, he did.

    The American Civil War was bound up in several specific issues; one of which was slavery (although Lincoln tended to ignore this one, until the Union had won some major victories on the battlefield, midway through the Civil War).

    Because the issue of slavery is of such monumental importance, it is very difficult (for me, at least) to turn a blind eye to this matter, and lead the cheers for the old Confederacy.

    But on the single issue of states' rights, I believe the Confederacy was essentially correct...

    I assume you mean it represented the last forlorn fling against legitimate authority?

    I see no fewer than 17 states have currently petitioned to secede. Texas leads the bunch.
