True but I'm not sure it's going to hold up if the company already set a precedence by not firing the male employee. She may have a case not only based on gender discrimination but also political discrimination.
It's important also to note that this is only one side of the story. The company has not responded.

My bad. Was just responding to the thread title.
If she feels she is being treated in an unequal way to another employer she'll need to provide the actual evidence. Which may provide her a moral victory (and might get the other person fired also). But the employer has an amount of discretion in who they decide to fire/keep. As long as they don't violate the "protected groups".

Employee of course. Like, for instance, I am client facing so I am expressly not allowed to be critical of employer, client, ANY of employer's clients and basically be searchable online in any other way than, essentially, 'plain vanilla' and that INCLUDES merely being associated with any political party.
The point being, if client's google my name, there's nothing anybody might disapprove of. Same goes with clothing. I'm in a suit, the non-client facing people I manage can show up any way they like. My standard is 'not completely tasteless' - you can be tasteless even....
I don't wear a suit every day of course because I keep one in the office just in case.
