    True but I'm not sure it's going to hold up if the company already set a precedence by not firing the male employee. She may have a case not only based on gender discrimination but also political discrimination.

    It's important also to note that this is only one side of the story. The company has not responded.

    Actually, she wasn't fired for flipping off anyone.

    She was fired by her employer for identifying the person in the viral picture as herself and then using the image as her Facebook profile photo.

    Yes, but the male employee did the same and took it further by including the companies logo. (those pesky additional little details.....hehehehe)

    My bad. Was just responding to the thread title.

    If she feels she is being treated in an unequal way to another employer she'll need to provide the actual evidence. Which may provide her a moral victory (and might get the other person fired also). But the employer has an amount of discretion in who they decide to fire/keep. As long as they don't violate the "protected groups".

    Thanks. Yes, I'm pretty squeaky clean too. I've always viewed my social profile like my SSN. Nothing but positive stuff. I think it helps that I don't really engage in facebook or the other social media platforms.
