    Marsy's Law Approved in Ohio

    Marsy's law has been approved as a constitutional amendment in Ohio. It will put into the Constitution victims’ rights to privacy, to information about services; to notification of proceedings, release and escape of the accused; to a prompt conclusion; to refuse discovery requests; to protection and to restitution.

    Those opposing it are concerned that the amendment gives victims legal standing in criminal cases. I had concerns about due process and it's constitutionality vis-à-vis the USC. We will see....

    I think the federal courts will gut it in due course. The accused have explicit federally protected Constitutional rights. The alleged victims do not. When there is conflict, the accused's rights rightly must trump those of the alleged victims.
