3. Punish the instigator, not the respondent.
This is something that has always confused me. Why is it that the instigator and the person who responds to instigation are treated the same? Nowhere else in society or law is the kind of standard adhered to. If someone sucker punched you and you punched them back, would you be just as guilty as the person who attacked you? Of course not. The idea that you can only punish an instigator if their victim failed to respond is just nonsensical.
