Hard to say. I can say its not 14 or even 16. It also depends on the actors involved. Two sixteen year olds is different from a 16 year old and a 30 year old. I suspect you would like it to be a nice tidy guideline but it can't be. IMO biological adulthood is not the bar to be used. I'll bring up the "obscenity" example as I have in the past in these types of situations. I don't know if I can define it, but I know it when I see it.

Actually, I'm against nice tidy guidelines. I have always believed it should be decided on a case-by-case basis and that all the various factors should be considered. More often than not, age of consent laws are about making parents feel better, not protecting the interests of minors.

I know a professional athlete who is 33 years old and if you talked to him, you'd see that he has the mental maturity of the 15 or 16 year old.

Physical maturity is objective. It can be demonstrated. Emotional maturity isn't and it can't. It's arbitrary and unscientific.

I'm not sure about that. One can discern anothers emotional age pretty readily. Certainly, there are psych profile metrics to at the very least be in the ballpark as to an individuals emotional age.

Really? What does that even mean? Yes, there are "psych" profiles but they are based around cognitive function. They help identify crazies and the mentally handicapped. When psychologists say someone has the mind of a child they don't mean he's immature. They mean he's a retard. Pardon my French.

I don't imagine there are very many third or fourth grade girls reaching puberty. Still, it is disturbing to use the exception to expain away a sexual attraction to young kids.
